Please read the following Terms and Conditions (“Terms”) carefully before accessing or using the laptap.com.ph Website (“Website”, “Our Website”) owned and operated by Laptap Enterprises, Inc. (“Laptap”, “we”, “us”, “our”). By accessing or using Our Website, you (“you”, “your”, “User”, “Customer”) acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part thereof, you may not access or use the Website. Please review these Terms from time to time as we reserve the right to revise them and other policies at any time by posting a new version on Our Website. You are, then, deemed to be aware of and bound by any changes thereupon. However, these changes will not affect rights and obligations that arose prior thereto. If you become dissatisfied with Our Website due to changes in the Terms, you may terminate use of Our Website.

• Our Website is an online marketing platform whereby you can browse and purchase our products and services.

Pricing and Product Information

• All prices are in Philippine Peso.
• Prices posted on Our Website are inclusive of government-imposed taxes.
• We exert our best efforts to provide you with accurate and up-to-date pricing and product information. However, we do not warrant against errors. In such case, we will inform you through call or text before processing your order.
• We do our utmost to display the colors of our products as accurately as possible on Our Website. We cannot guarantee, however, that the screen of your device or computer monitor will do the same.

Account

• Certain features of Our Website (such as but not limited to the purchase of products and services through Our Website) may be accessed and used only by Users who have a registered account with Our Website.
• To register, you will be required to expressly accept the Terms and provide true, accurate, current, and complete personal information which we are committed to ensure that it be secure. However, if we suspect otherwise, we reserve the right to suspend or terminate your account.
• We will not be held liable for any unauthorized activities that occur under your account. Thus, you are solely responsible for restricting access to your account by others and maintain confidentiality of your password.

Shopping

• Our products and services are sold through Our Website on a first-come, first-served basis and are subject to availability.
• Due to daily fluctuations of inventory levels, you may be able to place an order online for a product indicated on Our Website as available but is found out to be sold out upon processing of your order. Should this happen although rarely, we will immediately inform you through call or text.
• We do not accept reservations of our products; thus, even products placed in your shopping basket are not considered reserved and may be purchased by another User who was first able to complete the check-out and payment procedures.
• We accept payment through bank transfers (BDO, BPI and Metrobank), credit cards, GCash, Maya, and BillEase.
• Once your check-out and payment procedures are completed, our customer service team will verify your payment within 48 hours.
• After verification that your payment has been successfully made and within the same number of hours as mentioned above, you will receive an order confirmation via SMS.
• Cancellation or modification of order can no longer be made after payment of your order and confirmation thereof.

Shipping and Delivery

• We offer free shipping nationwide for laptops and tablets.
• To provide peace of mind to Customers, we offer cash-on-delivery (“C.O.D.”) service only through our official Facebook page: Laptap Enterprises, Inc. "C.O.D." is not available via website. With this system, you will only be required to pay for the product upon delivery; thus, securing your transaction with us. 
  
• A shipping confirmation with a tracking number will be sent via SMS once your order is shipped which will be made after your order and payment have been confirmed.
• Your order will be delivered to your specified shipping address within 2 to 7 working days provided there are no delays by the third-party courier. If your shipment takes longer than originally estimated, we will make every effort to assist in following up with the courier service and complete your order as quickly as possible.
• You may track your order by visiting LBC.com/tracking website and enter the tracking number provided by our representative. Please allow LBC to update its tracking information on their website within 24 hours after the shipment of your order.
• We aspire to ship and deliver your order as immediately as possible. Nonetheless, we cannot guarantee against delays resulting from unforeseen events, force majeure, or those attributed to the third-party courier.
• In addition to our Terms, you are also deemed bound by the terms and conditions provided by the third-party courier by availing the shipping or C.O.D. option.

Warranty Terms and Conditions

1. Warranty Scope

This warranty covers defects in hardware components under normal use during the warranty period.

2. Warranty Exclusions

This warranty does not cover:
a. Software-related issues; and
b. Damage resulting from negligence, misuse, mishandling, accidents, abuse, unauthorized modifications, or natural disasters.

3. Warranty Seal Policy

Any removal, tampering, or damage to the Laptap Enterprises warranty sticker/seal during the warranty period will automatically void the warranty.

4. Shipping Policy (Warranty Claims)

For out-of-town customers, return shipping costs for warranty claims shall be shouldered by the customer, provided that all shipping guidelines and policies have been followed.

5. Warranty Coverage

Once the unit has been inspected and approved by our warranty coverage assessor, the following terms shall apply:

Where applicable, the customer will be issued store credit, which may be used to purchase the same unit (if available) or any other unit of equal value

*Store Credit (T&C)

• Not convertible to cash.
• Valid for 12 months from the date of issuance.
• For single-use only, any unused credit amount will be forfeited.
  

6. Warranty Continuity

Replacement or repair of any part under warranty does not extend, renew, or reset the original warranty period of the unit. The warranty period shall remain based on the original date of purchase. Replaced parts are covered by a separate 3-month replacement warranty from the date of installation.

7. Inspection Clause

All warranty claims are subject to inspection and verification by Laptap Enterprises.

8. Repair Scope

Warranty service is limited to repair or replacement of defective parts and does not include refunds.

9. Data Liability

Laptap Enterprises shall not be liable for any data loss, whether incidental or consequential, regardless of cause. Customers are advised to back up their data before submitting the unit for service.

10. Laptap Enterprises reserves the right to determine eligibility based on inspection findings and internal guidelines, subject to applicable consumer protection laws.

11. For units no longer covered by the warranty, the customer is entitled to the following:

12. All faulty parts replaced under warranty must be surrendered to Laptap Enterprises.

13. As per DTI, a change of mind is not considered when requesting a replacement.

14. No cash refund. Remedies are limited to repair, replacement, or store credit.

Intellectual Property Rights

• Our Website and every material and proprietary information therein and in any of our social media accounts, including but not limited to designs, images, photographs, text, graphics, illustrations, logos, patents, copyrights, trademarks, service marks, audio, video, music, and all other intellectual property rights related thereto, including all code in Our Website (collectively “Laptap Content”, is the exclusive property of Laptap or used with express permission of the copyright and trademark owners.
• Use of Laptap Content for any purpose not expressly permitted by this Terms is strictly prohibited. You agree not to reproduce, distribute, sell, license, rent, modify, transmit, publish, adapt, edit, or create derivative works from Laptap Content and all materials accessible on this Website. Violation of this Terms may result in penalties including but not limited to criminal and/or civil.

Website Rules

• You agree and undertake not to do any of the following restricted activities:
• impersonate any person or entity or to falsely state or otherwise misrepresent your affiliation with any person or entity;
• use this Website for illegal purposes;
• attempt to gain unauthorized access to or otherwise interfere or disrupt other computer systems or networks connected to this Website or the Website itself.
• use or upload, in any way, any software or material that contains, or which you have reason to suspect that contains, viruses, damaging components, malicious code, or harmful components which may impair or corrupt this Website’s data or damage or interfere with the operation of another Customer’s computer or mobile device or this Website; and
• use this Website other than in conformance with the acceptable use pliicies of any connected computer networks, any applicable Internet standards, and other applicable laws.
• We may, from time to time and without giving any reason or prior notice, upgrade, modify, suspend, or discontinue the provision of or remove, whether in whlie or in part, this Website and shall not be liable if any such upgrade, modification, suspension, or removal prevents you from accessing the Website or any part thereof.
• We reserve the right, but not obligation, to do the following:
• monitor, screen, or otherwise control any activity, content, or material on this Website, and investigate any violation of the Terms contained on herein and take any action it deems appropriate;
• prevent or restrict access of any Customer to this Website;
• report any activity it suspects to be in violation of any applicable law, statute, or regulation to the appropriate authorities and cooperate there with; and/or
• request any information and data from you in connection with your use of and/or access to this Website and to exercise our rights under the Terms if you refuse to divulge such information and/or data or if you provide or if we have reasonable grounds to suspect that you have provided inaccurate, misleading or fraudulent information and/or data.
• Your use of and/or access to this Website is also subject to the Privacy Policy as set out here .

Limitation of Liability

• In no event shall Laptap, its affiliates, officers, directors, employees, agents, suppliers be liable to you for any direct, indirect, special, consequential, economic, exemplary, incidental, or punitive damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or directly or indirectly related to:
• The Terms – The Website, our social media accounts, and any other website or resource you access through a link from the Website;
• The products made available or purchased through our Website, including any damages or injury arising from any use of such products;
• The use of or inability to use the Website or any other information access; through the Website - or performance of any third party products or services; and
• The legality, accuracy, reliability, quality or authenticity of Laptap Content, advertisements, services or products provided by any party through the Website.
• Under no circumstances shall Laptap be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the Website or your accounts.
• Laptap’s liability to you for direct damages for any claim related to any of the foregoing shall in no event exceed the amount which you have paid to Laptap in conjunction with the product under which such claim first arose.

Indemnity

• You agree to defend, indemnify and hold harmless Laptap, its affiliates, officers, directors, employees, agents, suppliers, from and against any and all fines, penalties, claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ and experts’ fees) arising out of any of the following: (1) your use and access of the Website; (2) any product you purchase from the Website; (3) your violation of any term in this Terms; (4) your violation of any third-party right, including without limitation any right of privacy or intellectual property right; and/or (5) fraud you commit, or your intentional misconduct or gross negligence.

Dispute Settlement

• The Terms shall be governed by, construed in accordance with the laws of the Philippines, and you hereby submit to the exclusive jurisdiction of the Courts of Mandaue City in the Philippines.

Electronic Communication

• When you use or access the Website or send emails to Laptap, you are communicating with Laptap electronically. You consent to receive electronically any communications related to your use of the Service. Laptap will communicate with you by email or by providing notifications on the Website. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing. All notices from Laptap intended for receipt by a customer shall be deemed delivered and effective when sent to the email address you provide on Laptap.

Entire Agreement and Severability

• This Agreement shall constitute the entire agreement between you and Laptap concerning the Website. If any provision of this Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Terms, which shall remain in full force and effect.
• Laptap Enterprises reserves the final right of decision in case of any disputes.
